Scope of Application

These Terms of Use (hereinafter referred to as “Terms”) govern the use of Stagecast’s platform provided by Stagecast AB, org.no 559070-8425), (“Stagecast”, “we” or “us”) that enables real-time active engagement at an in-person or virtual workshop, meeting, live stream, or event (the “Service”) organized by third party Organizers (“Organizers”) for its participants (“Participants”).
These Terms apply within Sweden for both Participants and Organizers (collectively referred to as “Users”) when using the Service, unless otherwise is explicitly stated in these Terms.

The Service runs thanks to underlying systems, meaning the Stagecast software, IT solutions, systems, and networks (including software and hardware) owned by Stagecast and Stagecast’s licensors used to provide the Service, including any third party solutions, systems and networks and any software components Stagecast may make available, as part of or related to, the Service.
The Service is provided through our webpage stagecast.io (the “Webpage”). By using the Service, you accept these Terms and enter into an agreement with us. If you do not agree to these Terms, please do not use the Service provided by us.

License

Provided that you accept and adhere to these Terms, you are granted a non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You will not receive any other license to use the above intellectual property rights except as expressly provided in these Terms.You understand and accept that content posted on the Service may belong to third parties, and that we have no control over such content. Subsequently, you understand and accept that we cannot be held liable for such content supplied by third parties and presented or made available within the scope of the Service.We do not grant you or anyone else permission to copy or alter the software of the Service in whole or in part. It is not allowed to re-create the source code or its functionality, other than as expressly permitted by mandatory law.You may not use the Service to distribute viruses, trojans or similar programs. We do not allow automatic reading of the Service.All intellectual property rights in any other part of the Service, belongs to or are disposed of with license by us. Nothing in these Terms shall be construed as a transfer of any intellectual property right or any other right to you. You are only given the limited license as described above.

Your use of service

We do not want the Service to be used for anything other than its intended purpose. Your use of the Service may only be in accordance with its intended purposes, as described in these Terms. If you do not accept this, we ask you not to use the Service.

• You may upload content such as written comments, messages and photos (“User-generated Material”) to the Service.
• You agree and warrant that you will not distribute or upload any User-generated Material to the Services which: is false, misleading, untruthful, or inaccurate, promotes or encourages illegal activity, is racially or ethnically offensive and/or constitutes agitation against a minority (such as a national or ethnic group), constitutes defamation, contains pornography or is in any other way sexually explicit, attacks sexual orientation or religion or is discriminating in any other way, constitute insult or persecution of a person, is in any way harmful, abusive, offensive, or illegal or which infringes the rights of any third party (such as including but not limited to copyright and trademarks), or otherwise contradicts the Service’s intended purposes, or these Terms.

Network fees and access

You are responsible for securing your access to the network necessary to use the Service. There may be additional costs for e.g., transfers of data and messaging services. These costs are not paid by us. Furthermore, you are responsible for obtaining and keeping the necessary hard- or software up to date to access and use our Service.

Stagecast intends to use state-of-the-art technology and shall be entitled to regularly carry out or introduce updates, new versions, or upgrades of the Software in order to adapt the Software to new technical or commercial requirements, to implement new features, or to make changes to existing features in order to improve the Software.

Provisions applicable for Participants:
Persons under the age of 18 may not use the Service without parental consent.When using the Service, you will be asked to submit certain information about yourself. Stagecast processes personal data received in connection with the use of the Services. The personal data processing is made in accordance with our privacy policy (available here). Do not use the Service if you do not accept the privacy policy.

Payment

The use of the Service is free for Participants.

Term and termination

You have the right to terminate your User account and remove your User-generated Material from the Service at any time and without prior notice.

Provisions applicable for organizers:

The Organizer represents and warrants that it has the full legal authority to bind the organization it represents to these Terms. The Organizer also warrants that it will be responsible for its participants use of the Service, the content it asks its participants to upload to the Service and the personal data it collects as a controller of such personal data in connection with the Service.

Organizer is responsible for deleting User-generated Material that its participants upload to the Service if reasonable grounds exist for Stagecast or the Organizer to assume that the content is not in compliance with the provisions of these Terms.

Username and password

In order for the Organizer to use the Service, it will have to create a user account (the “User account”) and sign into it. Instructions on how to create a User account are set forth on the Webpage.Please note that if the User account is left inactive during a period of 90 consecutive days, we have the right to make the account “invisible”, meaning that all User account information is saved, but the User account is de-activated and needs to be activated for you to be able to use it again. Additionally, if the User account is left inactive during a period of 365 consecutive days, we have the right to cancel the User account permanently.

Software adaption

If agreed between the Organizer and Stagecast, Stagecast shall, in addition to providing the Service, provide services to adapt the Software to the individual needs and wishes of the Organizer as set out in a separate service agreement.

Data privacy

The Organizer agrees that Stagecast may process the content uploaded by the Organizer for the purposes of these Terms, in particular store such content and make it available for retrieval.Stagecast processes personal data received in connection with the use of the Services. The personal data processing is made in accordance with our privacy policy (available here.)Stagecast may transfer personal data from the Organizers’ participants to the Organizers, as set out in a data processing agreement entered into between the Organizer and Stagecast (available here).

Competitions on the Stagecast platform

If the Organizer uses the Service for the purpose of giveaways, sweepstakes, gambling, or prize giveaways, the Organizer is required to upload their own competition terms and are fully responsible for the fullfilment and transaction of prizes and giveaways, and any following tax responsibilities

Feedback

The Organizer agrees that Stagecast may freely use and further develop any feedback provided by the Organizer.

Payment

There are several types of plans offered under the Service. Stagecast may offer free plans (each a “Free Plan”) and paid plans (each a “Paid Plan”) for the subscription of the Service, (available here). Except for the Free plan, a payment of a fee according to these Terms is required.

Stagecast reserves the right to remove certain features from the Free Plans at its own discretion.

The Organizer may upgrade from a Free Plan to a Paid Plan, or switch to a more comprehensive Paid Plan at any time; in this case, from the time of the switch the details concerning the scope of services, fee, etc. of the new plan shall apply. A switch to a cheaper plan is only permissible with the consent of Stagecast or if the notice period specified in these Terms is observed.

The compensation for the use of the Software by the Organizer and the respective terms of payment shall be based on the pricing page (available here) In case of renewal of a Paid Plan, the version of the pricing page applicable to the Customer applies.

All fees and prices indicated by Stagecast are net prices without VAT. The payment period depends on the Paid Plan chosen by the Organizer and as set out on the Pricing Page and is performed by Stripe, as further described on the Webpage.

Term

A Free Plan runs for an indefinite period and may be terminated by either party with immediate effect.A Paid Plan runs for the time period set out on the Pricing Page or as separately agreed in writing between the Organizer and Stagecast. If no time period is stated on the Pricing Page, and no time period has been agreed between the Organizer and Stagecast, such Paid Plan may be terminated by either party with one month’s notice. Termination for Paid Plans must be made by a declaration in text form.

Disclaimer of warranty

The Service, including the Webpage, is provided ‘as is’ without warranties of any kind. Your use of the Service is solely your responsibility and at your own risk. We do not grant any warranties, expressed or implied or otherwise, as to the accessibility, quality, qualification for any particular purpose, suitability, or accuracy of the Webpage or the Service. Stagecast tries to ensure that the Service is available on a 24/7 basis. However, it is possible that on occasion the Service may be unavailable due to maintenance or circumstances beyond our control. We therefore recommend you not to rely on the Service for a purpose which is of high importance to you or which you consider intolerable if not met. In addition, we reserve the right to modify or discontinue providing the Service, at our sole discretion. To the extent permitted under mandatory law we are not liable to you or any third party for any direct, indirect, or other damages of any kind, including but not limited to, lost profits, loss of income, loss of revenue, business interruption or loss of goodwill arising out of, or in connection with, these Terms or the inability to use the Service. We are not responsible to you for any third party claims made against you. Our total liability to you in connection with the Service, for any injuries, losses, and legal actions, shall under no circumstances exceed the commission fee charged by us on the transactions made by you through the Service.

Indemnity and limitation of liability

You are liable for any damages inflicted on us, or any third party, due to your breach of these Terms, including but not limited to the misuse of the Webpage and/or the Service and unfair marketing. Furthermore, you agree to indemnify us in relation to any claims, costs (including reasonable legal costs) damages, expenses, liabilities, and losses incurred by us in relation to your breach of these Terms or other applicable law.Should any User-generated Material infringe a third party’s intellectual property right, you agree to immediately remove all infringing parts of the User-generated Material and indemnify us from all damages, costs and expenses incurred by us as a result of such infringement.

Change of terms and termination of services

We have the right to make changes and updates to these Terms. We will inform you of any such changes at the latest thirty (30) days before an adjustment enters into force. We will give you such information by a clear notice here.

We have the right to suspend your access to the Service with immediate effect if we have reason to believe that you are violating these Terms. Furthermore, we reserve the right to modify, discontinue, temporarily or permanently cease providing the Service at any time without prior notice, at our own discretion, or if required by law or by a decision by an authority. You accept that we shall not be liable to you or to any third party for such modification, suspension, or discontinuance.

Transfer

You may not assign or transfer any rights, obligations or licenses as provided in these Terms. We may assign and transfer our rights under these Terms without your consent and without notice to you.

Applicable law and disputes

These Terms shall be governed by and construed in accordance with Swedish laws, without regard to its conflict of law rules.

Any dispute or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be finally settled by Swedish courts, with the Stockholm District Court as the first instance, unless otherwise provided by mandatory law.

Diese Nutzungsbedingungen (im Folgenden „Bedingungen“) regeln die Nutzung der von Stagecast AB, Org.-Nr. 559070-8425 („Stagecast“, „wir“ oder „uns“) bereitgestellten Plattform, die es ermöglicht, bei einem persönlichen oder virtuellen Workshop, Meeting, Livestream oder Event in Echtzeit aktiv teilzunehmen („Dienst“), das von Dritten („Organisatoren“) für ihre Teilnehmer („Teilnehmer“) veranstaltet wird.
Diese Bedingungen gelten in Schweden sowohl für Teilnehmer als auch Organisatoren (zusammen „Nutzer“), sofern in diesen Bedingungen nicht ausdrücklich etwas anderes angegeben ist.

Der Dienst basiert auf zugrunde liegenden Systemen, d. h. der Stagecast-Software, IT-Lösungen, Systemen und Netzwerken (einschließlich Software und Hardware), die im Eigentum von Stagecast oder dessen Lizenzgebern stehen und zur Bereitstellung des Dienstes genutzt werden, einschließlich Lösungen, Systeme und Netzwerke Dritter sowie Softwarekomponenten, die Stagecast als Teil des Dienstes oder in Zusammenhang mit diesem zur Verfügung stellt.
Der Dienst wird über unsere Webseite stagecast.io (die „Webseite“) bereitgestellt. Durch die Nutzung des Dienstes akzeptieren Sie diese Bedingungen und schließen mit uns eine Vereinbarung. Wenn Sie diesen Bedingungen nicht zustimmen, nutzen Sie den Dienst bitte nicht.

Lizenz

Sofern Sie diese Bedingungen akzeptieren und einhalten, erhalten Sie eine nicht-exklusive, nicht übertragbare, widerrufliche Lizenz zur Nutzung des Dienstes für den vorgesehenen Zweck.
Sie erhalten keine weiteren Rechte an geistigem Eigentum, außer wie in diesen Bedingungen ausdrücklich vorgesehen.
Sie verstehen und akzeptieren, dass Inhalte, die im Rahmen des Dienstes bereitgestellt werden, Dritten gehören können und dass wir keine Kontrolle über solche Inhalte haben. Sie akzeptieren, dass wir für solche von Dritten bereitgestellten Inhalte, die im Rahmen des Dienstes präsentiert oder verfügbar gemacht werden, keine Haftung übernehmen.
Es ist nicht gestattet, die Software des Dienstes ganz oder teilweise zu kopieren oder zu verändern. Die Rekonstruktion des Quellcodes oder seiner Funktionen ist nur insoweit erlaubt, wie dies zwingendes Recht gestattet.
Sie dürfen den Dienst nicht zur Verbreitung von Viren, Trojanern oder ähnlichen Programmen nutzen. Eine automatisierte Auslesung des Dienstes ist nicht gestattet.
Alle Rechte an geistigem Eigentum in anderen Teilen des Dienstes stehen uns zu oder werden uns lizenziert. Diese Bedingungen übertragen Ihnen keinerlei geistige Eigentumsrechte oder sonstige Rechte, außer der oben genannten beschränkten Lizenz.

Ihre Nutzung des Dienstes

Der Dienst darf nur für den vorgesehenen Zweck genutzt werden. Jede Nutzung hat im Einklang mit diesen Bedingungen und den vorgesehenen Zwecken zu erfolgen. Wenn Sie dem nicht zustimmen, nutzen Sie den Dienst bitte nicht.

Sie können Inhalte wie schriftliche Kommentare, Nachrichten und Fotos („Nutzergenerierte Inhalte“) im Dienst hochladen.
Sie stimmen zu und gewährleisten, dass Sie keine nutzergenerierten Inhalte hochladen oder verbreiten, die:

• falsch, irreführend oder ungenau sind,

• illegale Aktivitäten fördern oder dazu anregen,

• rassistisch oder ethnisch anstößig sind und/oder gegen Minderheiten agitieren,

• verleumderisch sind, Pornografie enthalten oder in sonstiger Weise sexuell explizit sind,

• die sexuelle Orientierung oder Religion angreifen oder in anderer Weise diskriminierend sind,

• eine Person beleidigen oder verfolgen,

• in irgendeiner Weise schädlich, beleidigend, anstößig oder illegal sind,

• Rechte Dritter (einschließlich Urheberrechte oder Marken) verletzen,

• oder den vorgesehenen Zweck des Dienstes oder diese Bedingungen anderweitig verletzen.

Netzwerkgebühren und Zugang

Sie sind selbst für den Zugang zum erforderlichen Netzwerk verantwortlich. Es können zusätzliche Kosten entstehen (z. B. für Datentransfers oder Messaging-Dienste). Diese Kosten werden nicht von uns übernommen. Außerdem sind Sie verantwortlich, die erforderliche Hard- oder Software zu beschaffen und aktuell zu halten.

Stagecast beabsichtigt, modernste Technologien zu verwenden und ist berechtigt, regelmäßig Updates, neue Versionen oder Upgrades der Software einzuführen, um diese an neue technische oder geschäftliche Anforderungen anzupassen, neue Funktionen hinzuzufügen oder bestehende Funktionen zu verbessern.

Bestimmungen für Teilnehmer

Personen unter 18 Jahren dürfen den Dienst nicht ohne Zustimmung der Eltern nutzen. Bei Nutzung des Dienstes müssen Sie bestimmte persönliche Informationen angeben. Stagecast verarbeitet personenbezogene Daten gemäß unserer Datenschutzrichtlinie (abrufbar hier). Bitte nutzen Sie den Dienst nicht, wenn Sie diese Datenschutzrichtlinie nicht akzeptieren.

Zahlung

Für Teilnehmer ist die Nutzung des Dienstes kostenlos.

Laufzeit und Beendigung

Sie können Ihr Benutzerkonto und nutzergenerierte Inhalte jederzeit ohne Vorankündigung löschen.

Bestimmungen für Organisatoren

Der Organisator sichert zu, dass er berechtigt ist, seine Organisation an diese Bedingungen zu binden. Der Organisator ist verantwortlich für die Nutzung des Dienstes durch seine Teilnehmer, für die Inhalte, die er von Teilnehmern anfordert, sowie für die Erhebung personenbezogener Daten.
Der Organisator ist verpflichtet, nutzergenerierte Inhalte zu löschen, wenn Grund zur Annahme besteht, dass diese nicht den Bedingungen entsprechen.

Benutzername und Passwort

Zur Nutzung des Dienstes muss der Organisator ein Benutzerkonto erstellen und sich anmelden. Bleibt ein Benutzerkonto 90 Tage inaktiv, sind wir berechtigt, es zu deaktivieren. Nach 365 Tagen Inaktivität können wir es dauerhaft löschen.

Softwareanpassung

Wenn vereinbart, kann Stagecast die Software an individuelle Bedürfnisse des Organisators anpassen (separater Servicevertrag).

Datenschutz

Der Organisator stimmt zu, dass Stagecast hochgeladene Inhalte speichern und verfügbar machen darf. Stagecast verarbeitet personenbezogene Daten gemäß Datenschutzrichtlinie.
Personenbezogene Daten von Teilnehmern können gemäß einer gesonderten Vereinbarung an den Organisator übermittelt werden.

Wettbewerbe auf der Plattform

Bei Nutzung des Dienstes für Gewinnspiele ist der Organisator verpflichtet, eigene Teilnahmebedingungen bereitzustellen und für die Abwicklung sowie etwaige steuerliche Pflichten verantwortlich.

Feedback

Stagecast darf vom Organisator bereitgestelltes Feedback frei verwenden und weiterentwickeln.

Zahlung (für Organisatoren)

Es gibt kostenlose und kostenpflichtige Pläne. Stagecast kann Funktionen der kostenlosen Pläne entfernen.
Ein Upgrade ist jederzeit möglich; ein Downgrade nur mit Zustimmung oder Einhaltung der Kündigungsfrist.
Alle Preise verstehen sich netto ohne MwSt., Abrechnung erfolgt über Stripe.

Laufzeit

Kostenlose Pläne sind unbefristet, kostenpflichtige Pläne laufen gemäß Preisangaben oder schriftlicher Vereinbarung und können mit Frist gekündigt werden.

Haftungsausschluss

Der Dienst wird „wie besehen“ ohne jegliche Garantie bereitgestellt. Nutzung auf eigenes Risiko. Keine Gewähr für Verfügbarkeit, Qualität, Eignung oder Genauigkeit.
Wir haften nicht für direkte oder indirekte Schäden, soweit gesetzlich zulässig.

Schadloshaltung

Sie haften für Schäden, die durch Verletzung dieser Bedingungen entstehen, und stellen uns von Ansprüchen Dritter frei.

Änderungen und Einstellung des Dienstes

Wir können Bedingungen ändern (Ankündigung spätestens 30 Tage vorher) oder den Dienst jederzeit aussetzen oder einstellen.

Übertragung

Sie dürfen Rechte oder Pflichten aus diesen Bedingungen nicht übertragen. Wir dürfen dies ohne Ihre Zustimmung tun.

Anwendbares Recht und Gerichtsstand

Es gilt schwedisches Recht. Ausschließlicher Gerichtsstand ist Stockholm, sofern gesetzlich zulässig.

Ambito di applicazione

I presenti Termini di utilizzo (di seguito “Termini”) disciplinano l’uso della piattaforma di Stagecast fornita da Stagecast AB, org. no 559070-8425 (“Stagecast”, “noi” o “ci”), che consente il coinvolgimento attivo in tempo reale durante un workshop, una riunione, un live streaming o un evento, sia in presenza che virtuale (“Servizio”), organizzato da terze parti (“Organizzatori”) per i propri partecipanti (“Partecipanti”).
I presenti Termini si applicano in Svezia sia ai Partecipanti sia agli Organizzatori (collettivamente definiti “Utenti”) quando utilizzano il Servizio, salvo quanto diversamente e specificamente indicato nei presenti Termini.

Il Servizio funziona grazie a sistemi sottostanti, ovvero il software, le soluzioni IT, i sistemi e le reti (inclusi software e hardware) di proprietà di Stagecast e dei suoi licenziatari, utilizzati per fornire il Servizio, inclusi eventuali sistemi, reti e soluzioni di terzi, nonché qualsiasi componente software che Stagecast possa mettere a disposizione come parte o in relazione al Servizio.
Il Servizio è fornito tramite il nostro sito web stagecast.io (“Sito web”). Utilizzando il Servizio, accetti i presenti Termini e concludi un contratto con noi. Se non accetti i presenti Termini, ti invitiamo a non utilizzare il Servizio da noi fornito.

Licenza

A condizione che tu accetti e rispetti i presenti Termini, ti viene concessa una licenza non esclusiva, non trasferibile e revocabile per utilizzare il Servizio per lo scopo previsto.
Non riceverai alcun altro diritto di utilizzo della proprietà intellettuale sopra indicata, salvo quanto espressamente previsto dai presenti Termini.
Riconosci e accetti che i contenuti pubblicati sul Servizio possono appartenere a terze parti e che non abbiamo alcun controllo su tali contenuti. Di conseguenza, accetti che non possiamo essere ritenuti responsabili per tali contenuti forniti da terze parti e presentati o resi disponibili nell’ambito del Servizio.
Non concediamo a te né a terzi il permesso di copiare o modificare, in tutto o in parte, il software del Servizio. Non è consentito ricreare il codice sorgente o la sua funzionalità, salvo nei limiti consentiti dalla legge inderogabile.
Non puoi utilizzare il Servizio per distribuire virus, trojan o programmi simili. Non consentiamo la lettura automatica del Servizio.
Tutti i diritti di proprietà intellettuale su qualsiasi altra parte del Servizio appartengono a noi o sono da noi utilizzati in licenza. Nulla nei presenti Termini sarà interpretato come trasferimento di diritti di proprietà intellettuale o di qualsiasi altro diritto a tuo favore. Ti viene concessa esclusivamente la licenza limitata descritta sopra.

Uso del Servizio

Non vogliamo che il Servizio venga utilizzato per scopi diversi da quelli previsti. L’utilizzo del Servizio può avvenire solo in conformità con le finalità indicate nei presenti Termini. Se non accetti questa condizione, ti invitiamo a non utilizzare il Servizio.

Puoi caricare contenuti come commenti scritti, messaggi e foto (“Materiale generato dall’utente”) sul Servizio.
Accetti e garantisci di non distribuire o caricare Materiale generato dall’utente che:

• sia falso, fuorviante o inaccurato,

• promuova o incoraggi attività illegali,

• sia offensivo su base razziale o etnica e/o costituisca incitamento contro una minoranza,

• sia diffamatorio, contenga pornografia o sia in qualsiasi altro modo sessualmente esplicito,

• attacchi l’orientamento sessuale o la religione o sia in altro modo discriminatorio,

• costituisca insulto o persecuzione di una persona,

• sia in qualsiasi modo dannoso, offensivo, illecito o che violi i diritti di terzi (inclusi, a titolo esemplificativo, diritti d’autore e marchi),

• o che altrimenti contraddica le finalità del Servizio o i presenti Termini.

Costi di rete e accesso

Sei responsabile di assicurarti l’accesso alla rete necessaria per utilizzare il Servizio. Possono esserci costi aggiuntivi per, ad esempio, trasferimenti di dati e servizi di messaggistica, non coperti da noi. Inoltre, sei responsabile di ottenere e mantenere aggiornati l’hardware e il software necessari per accedere e utilizzare il Servizio.

Stagecast si impegna a utilizzare tecnologie all’avanguardia ed è autorizzata a eseguire o introdurre regolarmente aggiornamenti, nuove versioni o upgrade del software per adattarlo a nuove esigenze tecniche o commerciali, implementare nuove funzionalità o modificare quelle esistenti per migliorare il Servizio.

Disposizioni per i Partecipanti

Le persone di età inferiore ai 18 anni non possono utilizzare il Servizio senza il consenso dei genitori. Durante l’uso del Servizio ti sarà richiesto di fornire alcune informazioni personali. Stagecast tratta i dati personali ricevuti in relazione all’uso del Servizio in conformità con la nostra informativa sulla privacy (disponibile qui). Non utilizzare il Servizio se non accetti l’informativa sulla privacy.

Pagamento

L’utilizzo del Servizio è gratuito per i Partecipanti.

Durata e cessazione

Hai il diritto di chiudere il tuo account utente ed eliminare il Materiale generato dall’utente in qualsiasi momento senza preavviso.

Disposizioni per gli Organizzatori

L’Organizzatore dichiara e garantisce di avere la piena autorità legale per vincolare l’organizzazione che rappresenta ai presenti Termini. L’Organizzatore è inoltre responsabile per l’uso del Servizio da parte dei suoi partecipanti, per i contenuti che chiede loro di caricare e per i dati personali che raccoglie come titolare del trattamento in relazione al Servizio.
L’Organizzatore è responsabile di eliminare il Materiale generato dagli utenti caricato dai partecipanti se esistono motivi ragionevoli per ritenere che il contenuto non sia conforme ai presenti Termini.

Nome utente e password

Per utilizzare il Servizio, l’Organizzatore deve creare un account utente e accedervi. Se un account rimane inattivo per 90 giorni consecutivi, ci riserviamo il diritto di renderlo “invisibile”. Dopo 365 giorni consecutivi di inattività, possiamo cancellarlo definitivamente.

Adattamento del software

Se concordato tra Organizzatore e Stagecast, Stagecast può adattare il software alle esigenze specifiche dell’Organizzatore, come stabilito in un accordo di servizio separato.

Protezione dei dati

L’Organizzatore accetta che Stagecast possa trattare i contenuti caricati ai fini dei presenti Termini, archiviarli e renderli disponibili per il recupero. Stagecast tratta i dati personali in conformità con la nostra informativa sulla privacy.
Stagecast può trasferire i dati personali dei partecipanti agli Organizzatori come stabilito in un accordo sul trattamento dei dati.

Concorsi sulla piattaforma Stagecast

Se l’Organizzatore utilizza il Servizio per concorsi, estrazioni o premi, è tenuto a caricare i propri termini del concorso ed è pienamente responsabile della gestione e della consegna dei premi, nonché degli obblighi fiscali correlati.

Feedback

L’Organizzatore accetta che Stagecast possa liberamente utilizzare e sviluppare ulteriormente qualsiasi feedback fornito.

Pagamento (per gli Organizzatori)

Sono disponibili piani gratuiti e a pagamento. Stagecast può rimuovere funzionalità dai piani gratuiti a propria discrezione.
L’Organizzatore può passare a un piano superiore in qualsiasi momento; il passaggio a un piano inferiore è consentito solo con il consenso di Stagecast o rispettando il periodo di preavviso.
Tutti i prezzi sono al netto dell’IVA. I pagamenti sono gestiti tramite Stripe, come descritto sul sito web.

Durata

Un piano gratuito ha durata illimitata e può essere risolto in qualsiasi momento. Un piano a pagamento ha durata come indicato nella pagina dei prezzi o come concordato per iscritto e può essere risolto con un mese di preavviso.

Esclusione di garanzia

Il Servizio, incluso il Sito web, è fornito “così com’è” senza garanzie di alcun tipo. L’uso del Servizio è a tuo esclusivo rischio. Non forniamo garanzie, espresse o implicite, sulla disponibilità, qualità, idoneità a uno scopo particolare o accuratezza. Stagecast si impegna a mantenere il Servizio disponibile 24/7, ma possono verificarsi interruzioni per manutenzione o cause di forza maggiore.
Nella misura consentita dalla legge, non siamo responsabili per danni diretti o indiretti derivanti dall’uso del Servizio.

Manleva e limitazione di responsabilità

Sei responsabile di eventuali danni causati a noi o a terzi derivanti dalla violazione dei presenti Termini e ci manlevi da qualsiasi reclamo, costo o spesa correlata.

Modifica dei Termini e cessazione del Servizio

Ci riserviamo il diritto di modificare i presenti Termini con preavviso di almeno 30 giorni. Possiamo sospendere o interrompere il Servizio in qualsiasi momento senza preavviso.

Trasferimento

Non puoi cedere o trasferire diritti o obblighi derivanti dai presenti Termini. Possiamo farlo noi senza il tuo consenso.

Legge applicabile e foro competente

I presenti Termini sono regolati dal diritto svedese. Eventuali controversie saranno di competenza esclusiva del Tribunale distrettuale di Stoccolma, salvo disposizioni inderogabili di legge.

Champ d’application

Les présentes conditions d’utilisation (ci-après les « Conditions ») régissent l’utilisation de la plateforme Stagecast fournie par Stagecast AB, numéro d’organisation 559070-8425 (« Stagecast », « nous » ou « notre »), qui permet une interaction active en temps réel lors d’un atelier, d’une réunion, d’un live stream ou d’un événement, en présentiel ou virtuel (le « Service »), organisé par des tiers (« Organisateurs ») pour leurs participants (« Participants »).
Les présentes Conditions s’appliquent en Suède à la fois aux Participants et aux Organisateurs (ci-après collectivement les « Utilisateurs ») lors de l’utilisation du Service, sauf indication contraire expresse dans ces Conditions.

Le Service repose sur des systèmes sous-jacents, à savoir le logiciel Stagecast, les solutions informatiques, les systèmes et réseaux (y compris logiciels et matériels) appartenant à Stagecast et à ses concédants de licence, utilisés pour fournir le Service, y compris toute solution, système ou réseau tiers, ainsi que tout composant logiciel que Stagecast peut mettre à disposition dans le cadre ou en lien avec le Service.
Le Service est fourni via notre site web stagecast.io (le « Site web »). En utilisant le Service, vous acceptez les présentes Conditions et concluez un contrat avec nous. Si vous n’acceptez pas ces Conditions, veuillez ne pas utiliser le Service que nous proposons.

Licence

À condition que vous acceptiez et respectiez les présentes Conditions, il vous est accordé une licence non exclusive, non transférable et révocable pour utiliser le Service aux fins prévues.
Aucun autre droit de propriété intellectuelle ne vous est accordé, sauf disposition expresse dans les présentes Conditions.
Vous comprenez et acceptez que le contenu publié sur le Service puisse appartenir à des tiers et que nous n’avons aucun contrôle sur ce contenu. Par conséquent, vous comprenez et acceptez que nous ne puissions être tenus responsables de ce contenu fourni par des tiers et affiché ou rendu disponible dans le cadre du Service.
Nous ne vous autorisons pas, ni quiconque, à copier ou modifier le logiciel du Service, en tout ou partie. La reconstitution du code source ou de ses fonctionnalités n’est autorisée que dans la mesure permise par la loi impérative.
Vous ne pouvez pas utiliser le Service pour diffuser des virus, chevaux de Troie ou programmes similaires. La lecture automatisée du Service n’est pas autorisée.
Tous les droits de propriété intellectuelle sur toute autre partie du Service nous appartiennent ou nous sont concédés sous licence. Aucune disposition des présentes Conditions ne saurait être interprétée comme un transfert de droit de propriété intellectuelle ou autre droit à votre profit. Vous ne recevez que la licence limitée décrite ci-dessus.

Utilisation du Service

Le Service ne doit pas être utilisé à des fins autres que celles prévues. Votre utilisation doit être conforme aux objectifs décrits dans les présentes Conditions. Si vous n’acceptez pas cela, veuillez ne pas utiliser le Service.

Vous pouvez télécharger du contenu tel que des commentaires écrits, messages et photos (« Contenu généré par l’utilisateur ») sur le Service.
Vous acceptez et garantissez que vous ne diffuserez pas et ne téléchargerez pas de Contenu généré par l’utilisateur qui :

• est faux, trompeur ou inexact,

• promeut ou encourage des activités illégales,

• est offensant sur le plan racial ou ethnique et/ou constitue une incitation contre une minorité,

• est diffamatoire, contient de la pornographie ou est autrement sexuellement explicite,

• attaque une orientation sexuelle ou une religion ou est discriminatoire de toute autre manière,

• constitue une insulte ou une persécution d’une personne,

• est nuisible, abusif, offensant ou illégal,

• viole les droits d’un tiers (y compris, mais sans s’y limiter, les droits d’auteur et les marques),

• ou contredit autrement les objectifs du Service ou les présentes Conditions.

Frais de réseau et accès

Vous êtes responsable de votre accès au réseau nécessaire à l’utilisation du Service. Des coûts supplémentaires peuvent s’appliquer pour, par exemple, les transferts de données ou les services de messagerie. Ces coûts ne sont pas pris en charge par nous. Vous êtes également responsable de l’acquisition et de la mise à jour du matériel ou des logiciels nécessaires pour accéder au Service et l’utiliser.

Stagecast s’efforce d’utiliser une technologie de pointe et est autorisé à effectuer ou à introduire régulièrement des mises à jour, nouvelles versions ou améliorations du logiciel afin de l’adapter à de nouvelles exigences techniques ou commerciales, d’ajouter de nouvelles fonctionnalités ou de modifier les fonctionnalités existantes pour améliorer le Service.

Dispositions applicables aux Participants

Les personnes de moins de 18 ans ne peuvent pas utiliser le Service sans le consentement de leurs parents. Lors de l’utilisation du Service, il vous sera demandé de fournir certaines informations personnelles. Stagecast traite les données personnelles reçues dans le cadre de l’utilisation du Service conformément à notre politique de confidentialité (disponible ici). N’utilisez pas le Service si vous n’acceptez pas cette politique.

Paiement

L’utilisation du Service est gratuite pour les Participants.

Durée et résiliation

Vous avez le droit de fermer votre compte utilisateur et de supprimer votre Contenu généré par l’utilisateur à tout moment et sans préavis.

Dispositions applicables aux Organisateurs

L’Organisateur déclare et garantit avoir pleine autorité légale pour engager l’organisation qu’il représente aux présentes Conditions. L’Organisateur garantit également qu’il sera responsable de l’utilisation du Service par ses participants, du contenu qu’il leur demande de télécharger et des données personnelles qu’il collecte en tant que responsable du traitement dans le cadre du Service.
L’Organisateur est responsable de la suppression du Contenu généré par l’utilisateur téléchargé par ses participants s’il existe des motifs raisonnables de penser que ce contenu n’est pas conforme aux présentes Conditions.

Nom d’utilisateur et mot de passe

Pour utiliser le Service, l’Organisateur doit créer un compte utilisateur et s’y connecter. Si le compte reste inactif pendant 90 jours consécutifs, nous avons le droit de le rendre « invisible ». Après 365 jours consécutifs d’inactivité, nous pouvons le supprimer définitivement.

Adaptation du logiciel

Si convenu entre l’Organisateur et Stagecast, Stagecast peut adapter le logiciel aux besoins spécifiques de l’Organisateur, conformément à un contrat de service séparé.

Protection des données

L’Organisateur accepte que Stagecast puisse traiter le contenu téléchargé aux fins prévues dans les présentes Conditions, l’enregistrer et le rendre disponible. Stagecast traite les données personnelles conformément à notre politique de confidentialité.
Stagecast peut transférer les données personnelles des participants de l’Organisateur à celui-ci, conformément à un accord de traitement des données conclu entre les parties.

Concours sur la plateforme Stagecast

Si l’Organisateur utilise le Service pour des concours, tirages au sort ou distributions de prix, il doit télécharger ses propres conditions de participation et est pleinement responsable de la remise des prix et des obligations fiscales associées.

Commentaires

L’Organisateur accepte que Stagecast puisse utiliser librement et développer toute remarque ou suggestion fournie.

Paiement (pour les Organisateurs)

Il existe des formules gratuites et payantes. Stagecast peut supprimer certaines fonctionnalités des formules gratuites à sa discrétion.
L’Organisateur peut passer à une formule supérieure à tout moment ; passer à une formule inférieure n’est possible qu’avec le consentement de Stagecast ou en respectant le délai de préavis indiqué.
Tous les tarifs s’entendent hors TVA. Le paiement est effectué via Stripe, comme décrit sur le Site web.

Durée

Une formule gratuite est à durée indéterminée et peut être résiliée à tout moment. Une formule payante est à durée déterminée selon la page des tarifs ou un accord écrit et peut être résiliée avec un préavis d’un mois.

Exclusion de garantie

Le Service, y compris le Site web, est fourni « tel quel » sans aucune garantie. Votre utilisation est à vos risques et périls. Nous ne garantissons pas la disponibilité, la qualité, l’adéquation à un usage particulier ou l’exactitude. Stagecast s’efforce d’assurer une disponibilité 24h/24 et 7j/7, mais des interruptions peuvent survenir.
Dans la mesure permise par la loi, nous ne sommes pas responsables des dommages directs ou indirects liés à l’utilisation du Service.

Indemnisation et limitation de responsabilité

Vous êtes responsable de tout dommage causé à nous ou à des tiers en raison de la violation des présentes Conditions et vous nous garantissez contre toute réclamation ou dépense liée.

Modification des Conditions et cessation du Service

Nous pouvons modifier les présentes Conditions avec un préavis d’au moins 30 jours. Nous pouvons suspendre ou interrompre le Service à tout moment, sans préavis.

Cession

Vous ne pouvez céder ni transférer vos droits ou obligations prévus par les présentes Conditions. Nous pouvons le faire sans votre consentement.

Droit applicable et juridiction compétente

Les présentes Conditions sont régies par le droit suédois. Tout litige relève de la compétence exclusive du tribunal de district de Stockholm, sauf disposition légale impérative contraire.
